Sections 359, 360, 361 and 364
De facto guardian-A person may neither be a legal guardian nor a guardian appointed by the Court but may have voluntarily placed himself incharge of the person and property of a minor. Such a person is called de facto guardian. A de facto guardian is merely a custodian of the person and property of the minor. Section 364 leaves no doubt that a de facto guardian has no power to transfer any right or interest in the immovable property of the minor.

De facto guardian-applicability of Limitation Act
Even the limitation Act is not applicable in the case since as per provision of law it is clear that the alleged transferred of minor property by "de facto guardian" the mother is void.

De facto guardian
The Muslim Law very zealously guard the interest of the minor, and the Holy Quran has 5 at more than one place given very great prominence to the minors and their interest in the property. In view of this prominence it is impossible to even imagine that the de facto guardian would be given a power to arbitrarily decide as to what would be the interest of the minor, and then to deal with his property on that basis. Under the Muslim Law a de facto guardian has under no circumstance any power to alienate the minor's property in any form.
