No Injunction for Plaintiffs Without Legal Title or Possession
Injunction can not be granted on the seeking of the plaintiff when he has no legal character as to title and possession of the suit property– The period of lease having been expired the plaintiff has no legal character as to the title and possession of the suit fishery and as such he is not entitled to get any injunction against the Government restraining it from leasing out the suit fishery by auction. The possession of the plaintiff in the suit fishery is the possession of a trespasser which can not be protected under any law.
