sale of any mortgaged property at a low price and if it finds that the property
is sold at the low price, it should not approve the sale
The Appellate Division observed that in many
cases that even after selling the mortgaged property the debtors remain in-
debted to the financial institutions if the decretal amount is higher than the
sale price. Most of the debtors could not pay the outstanding dues for various
reasons. Such default cannot be imputed upon them alone in all cases. Though it
is true that most of the debtors in collusion with officials of banks take
excess loan than the amount actually required and spend the excess amount
lavishly. There are exceptions in this regard. Sometimes the situation com-
pels them to become defaulters over which they had no control at all. If the
mortgaged property is sold at the standard prevailing market price, the debtors
may be relieved of heavy financial liability. In this case, if the property was
sold at the actual market price, the debtor would get a substantial amount of
money after repayment of the outstanding dues. In view of the above, Appellate
Division set aside the auction sale. Appellate Division direct the peti- tioner
Jamila Tannery Limited to deposit Tk. 7,30,00,000/- plus TK. 75,00,000/- as
compensation for payment to the auction purchaser and Tk. 25,00,000/- to the
bank as cost of the litigation plus receiver's re- muneration by 26.10.1917
with the Bank- ruptcy Court, failing which, the auction sale shall stand. The
pay order/bank draft deposited by the petitioner be released forthwith subject
to payment of money as mentioned above. This petition is disposed of with the
above observations and direc- tions.
