Record of Rights
Entry of the C. S. record of rights cannot be
presumed to be false in the absence of any evidence- The Appellate Division
observed that the appellate Court below reversed the findings and decisions of
the trial Court on making observations to the effect that according to the
entry of the C. S. record the predecessor-in-interest of the plaintiffs namely
Bakshu Sheikh Be- pari used to possess the suit land on the strength of 'cot
kabala' and that this entry of the C. S. record of rights can not be pre- sumed
to be false in the absence of any evidence at all, that in this suit the onus
was on the defendants to prove that Abdul Gafur released the suit property from
Bak- shu Sheikh Bepari upon payment of debt, but no such evidence could be
adduced by the defendants. The appellate Court below has made observations to
the effect also that the defendants have failed to adduce any evidence whatsoever
to prove their case that Abdul Gafur sold the suit land orally to their
predecessors in the year 1340 B.S. The High Court Division affirmed these
observations and findings of the ap- pellate Court below. Accordingly Appellate
Division dismissed the instant appeal.
