The subsequent fresh writ petition (Motion)
has to be filed within a reason- able time preferably within 30 days from the
date of earlier rejection as not being pressed
The High Court Division held that to have an
effective compliance of the first requirement of the rules, there shall be a
specific statement in the later writ petition quoting the new/different ground
and that to appreciate the said new/different ground of the writ petition, it
is proper if the Bench which heard the previous motion (writ petition), subject
to availability, hears the said fresh writ petition. Moreover, this special
privilege should not be allowed to enjoy for an indefinite period causing pre-
judice to the other part of the litigation and also in contradiction to the
principle, delay defeats equity. Therefore, the subsequent fresh writ petition
(Motion) has to be filed within a reasonable time preferably within 30 days
from the date of earlier rejection as not being pressed following the provision
of validity period of affidavit of a new writ petition (Motion) as provided in
rule-4 of chapter IVA of the High Court Division Rules.
