There is no doubt that in an exceptional circumstance, as for example in the case of an extreme urgency or whether the order of injunction is, on the face of it, without jurisdiction, an application under Order XXXIX, rule 4 of the Code may be made for varying an ex parte order made under rule 3 of the Order but such an application can be disposed of only on hearing the parties on merit, which is likely to he almost similar to the hearing of the parties in pursuance of a notice under rule.
