এটা সুপ্রতিষ্ঠিত যে কোনও কর্মকর্তাকে চলতি দায়িত্বের ভিত্তিতে উচ্চ পদে কাজ করার অনুমতি দেওয়া পদোন্নতি নয়, বরং সাময়িকভাবে একটি অতিরিক্ত দায়িত্ব এবং এই ধরনের চলতি দায়িত্বপ্রাপ্ত কর্মকর্তাকে কোনও কারণ উল্লেখ না করেই যেকোনো সময় তার মূল পদে ফিরিয়ে আনা যেতে পারে এবং এই ধরনের চলতি দায়িত্ব গ্রহণের মাধ্যমে সংশ্লিষ্ট কর্মকর্তা কোনও অর্জিত অধিকার লাভ করেন না।...(১১)

সংবিধানের ১৩৫ (১) অনুচ্ছেদের অধীনে সুরক্ষা এবং এই ধরনের সুরক্ষা সংসদ তার আইন প্রণয়ন ক্ষমতা বা রাষ্ট্রপতি তার বিধি প্রণয়ন ক্ষমতার মাধ্যমে কেড়ে নিতে পারে না। সংবিধানের ১৩৫ অনুচ্ছেদের অধীনে প্রদত্ত সাংবিধানিক গ্যারান্টি এমন একজন কর্মকর্তার চেয়ে কম পদমর্যাদার কর্মকর্তা হিসাবে মনোনীত করে হ্রাস করা যায় না যিনি নিয়োগের সময় নিয়োগকারী কর্তৃপক্ষ ছিলেন.....(১৮)

Current Charge

When an officer acts as 'current charge' on being duly authorized by the competent authority/person, of an officer he in all intent and purport or in other words in all respects acts as an officer assigned to that office or post and performs the functions and duties of that offices an officer duly authorized and that unless specified that the 'current charge' would perform only the assigned functions and duties but not the entire functions and duties of that office. .(23)
