Bar on Temporary Injunctions of Family Court
The Family Court constituted under the Family Courts Ordinance (XVIII of 1985) cannot grant temporary injunction under Order XXXIX, rule 1, CPC in view of the bar of section 20 of the Family Courts Ordinance No. XVIII of 1985. Since there is prima facie separation or talaq between the petitioner and the OP No.1, the Court cannot grant any injunction restraining the opposite party Nos.2-4 from giving the OP No.1 in marriage to anyone or elsewhere.
