32 DLR 1 (SC)-Bangladesh Vs. Shah- Jahan Siraj-The existence of a special law, however, does not mean exclusion of the Code, unless the special law expressly or impliedly provides that certain offences shall be tried exclusively by courts constituted. The effect of section 1 (2) in the background of section 29 of the Code is that where the special law provides for trial of particular offences by particular courts they shall be so tried exclusively. Every Court, in the absence of any express provision in the Code for that purpose. must be deemed to possess, as inherent in Its constitution, all such powers as are necessary to do the right and to undo a wrong in the course of the administration of justice. A Special Tribunal, although a criminal court, constituted by the Special Statute, is not a criminal court within the meaning of the Criminal Procedure.
32 DLR 1 (SC) – কতিপয় অপরাধের বিচার একান্তভাবে বিশেষ আইনে গঠিত আদালতের দ্বারা অনুষ্ঠিত হবে এই মর্মে উক্ত আইনে স্পষ্ট বা অস্পষ্টভাবে কোন কিছু বলা না থাকলে উক্ত বিশেষ আইন ফৌজদারী কার্যবিধিকে বহির্ভূত করবে না। কার্যবিধির ২৯ ধারার প্রেক্ষিতে ১(২) ধারার মূল কথা হচ্ছে, যে ক্ষেত্রে বিশেষ আইনে বিশেষ। আদালতের দ্বারা বিশেষ অপরাধের বিচারের বিধান করা। হয়েছে, সেক্ষেত্রে উক্ত অপরাধের বিচার সম্পূর্নভাবে ঐ আদালতে অনুষ্ঠিত হবে। ন্যায়বিচার পরিচালনাকালে ন্যায় কার্য করতে এবং অন্যায় নস্যাৎ করতে যেমন প্রয়োজন হবে তেমন সমস্ত ক্ষমতা, কার্যবিধিতে এই মর্মে কোন স্পষ্ট বিধান না থাকলেও প্রত্যেক আদালতের গঠনতন্ত্রে অন্তর্নিহিত হিসাবে থাকবে। বিশেষ আইনে গঠিত বিশেষ ট্রাইব্যুনাল ফৌজদারী আদালত হলেও ফৌজদারী কার্যবিধি। অনুসারে উহা কোন ফৌজদারী আদালত নয়।
