Dowry

The payment must be 'as a consideration for the marriage' to be considered as dowry. Dowry

To attract the provision of section 6 of the Ordinance there must be causing of death or grievous hurt or attempt to cause death or grievous hurt to a woman for dowry. Causing of simple hurt does not bring the offence within the mischief of section 6 of the Cruelty to Women (Deterrent Punishment) Ordinance, 1983. Dr Atikur Rahman Vs State, 14BLD (HCD)303

 Dowry-its ingredients

"Dowry" as defined in section 2 of the Act contains four ingredients: (1) it has to be any property or valuable security, (2) it has to be given or agreed to be given either directly or indirectly by the parties mentioned in clauses (a) or (b), (3) it has to be given or agreed to be given at the time of marriage or at any time before or after the marriage and (4) it must be as a consideration for the marriage.

Section 3 of the Act makes the giving and taking of dowry and the abetment thereof an offence while section 4 makes the demand of dowry an offence.

If a fresh demand for dowry is made after solemnization of marriage, about which there was no prior agreement and which demand does not fall strictly within the definition of dowry as contemplated in section 2, such a demand becomes an offence under section 4of the Act-Dowry Prohibition Act, 1980.
