Anti-Corruption Commission (Employees) Rules, 2008
Rules 10(2) and 11(Gha)-Except rule 10(2) and 11 (gha) of the Rules, no where within the four corners of the Rules, 2008 it has prescribed that the officers and employees of the defunct Bureau who have been retained under section 35(2) by the Commission will be kept under observation for 1(one) year from the dale the order has been passed, nor the Commission has been able to show the legal basis for imposition of such condition. Rules 10(2) and 11(Gha)-The Commission has included the name of those persons in the impugned gradation list who do not possess the requirement as prescribed in the Rules, 2008. Preparing the impugned gradation list for promotion to the post of Deputy Director is tainted with malafide as such, alternative forum even if there be available, will not be a bar invoking forum under Article 102 of the Constitution.
