হাইকোর্ট বিভাগের বিজ্ঞ বিচারকগণ পক্ষগণের শুনানি শেষে ৯ই ডিসেম্বর, ২০০৯ তারিখের রায় ও আদেশ দ্বারা রুল nisi চূড়ান্ত করেন এবং ১১ই নভেম্বর, ২০০৮ তারিখের বিতর্কিত স্মারক, যাতে রিট প্রতিপক্ষ নং ৫ কে ফরিদপুর জেলা মিনিবাস মালিক গ্রুপের প্রশাসক হিসেবে নিয়োগ করা হয়েছে, আইনানুগ কর্তৃত্ব ছাড়াই পাস হয়েছে এবং এর কোনো আইনগত কার্যকারিতা নেই বলে ঘোষণা করেন। গণপ্রজাতন্ত্রী বাংলাদেশ সরকার বনাম মোঃ আব্দুল কাইয়ুম মিয়া (এস.কে. সিনহা জে) (দেওয়ানী) ৭ এডিসি ৩০৪
section 3(2)(d)
No licence shall be granted for registra- tion under the Act to a trade Organisation unless it is an Association of trade or industry both, organised on all-Bangladesh basis, to represent spe- cific trades or industries or both. Provided that a licence for registration of such an Association shall not be granted to more than one trade organi- sation. .......(14)
the word "vegetables" must be con- strued neither in a technical sense nor from the botanical point of view; it should he understood as in ordinary phraseology. .......(16)
Everything that looks green is not a vegetable. At the same time, all a per- son intake is not infallibly for appeas- ing his/her hunger. For a common per- son of ordinary prudence, vegetables meant plants cultivated for food which are described in common usages as Sak-Sabzi, Asnaz, Tarkarl and fruits are known as Fol etc and "betel leaves" or Pans are in no way foodstuffs, as such, cannot be termed as vegetable or fruit or allied products of vegetable or fruit. No one, ordinarily, chew betel leaves as a food. A word which is not defined in any Act but which is a word of day to day use must be construed in its popu- lar sense. .(18)

ধারা ৩(২)(ঘ)
কোনো বাণিজ্য সংগঠনকে আইনের অধীনে নিবন্ধনের জন্য লাইসেন্স দেওয়া হবে না যদি না এটি বাণিজ্য বা শিল্প উভয়েরই একটি সমিতি হয়, যা নির্দিষ্ট বাণিজ্য বা শিল্প বা উভয়টির প্রতিনিধিত্ব করার জন্য সর্ব-বাংলাদেশ ভিত্তিতে সংগঠিত। তবে এই ধরনের কোনো সমিতির নিবন্ধনের জন্য একটির বেশি বাণিজ্য সংগঠনকে লাইসেন্স দেওয়া হবে না। .......(১৪)
"শাকসবজি" শব্দটি কারিগরি অর্থে বা উদ্ভিদতাত্ত্বিক দৃষ্টিকোণ থেকে ব্যাখ্যা করা উচিত নয়; এটি সাধারণ ভাষায় বোঝা উচিত। .......(১৬)
সবুজ দেখালেই তা সবজি নয়। একই সময়ে, একজন ব্যক্তি যা গ্রহণ করে তা অগত্যা তার ক্ষুধা নিবারণের জন্য নয়। সাধারণ জ্ঞানের একজন সাধারণ ব্যক্তির জন্য, শাকসবজি বলতে বোঝায় খাদ্যের জন্য চাষ করা উদ্ভিদ যা সাধারণ ব্যবহারে শাক-সবজি, আসনাজ, তরকারি হিসাবে বর্ণিত হয় এবং ফলগুলি ফল ইত্যাদি হিসাবে পরিচিত এবং "পান" কোনোভাবেই খাদ্যসামগ্রী নয়, তাই এটিকে সবজি বা ফল বা সবজি বা ফলের সহযোগী পণ্য হিসাবে আখ্যায়িত করা যায় না। সাধারণত কেউ খাদ্য হিসেবে পান চিবোয় না। যে শব্দটি কোনো আইনে সংজ্ঞায়িত করা হয়নি কিন্তু যা দৈনন্দিন ব্যবহারের একটি শব্দ তা তার জনপ্রিয় অর্থে ব্যাখ্যা করতে হবে। .(১৮)
