Regulations 40(2)

Rule 40 of the REB service Rules envisages two categories of penalties, namely, minor penalties and major penalties. Under Rule 40 (1) (Kha) four types of major penalties can be inflicted upon a delinquent employee who has been found guilty of major offences, namely, misconduct, corruption, theft, misappropriation, cheating and prejudi- cial act against national security or any subversive act as per provisions of Rule 39 (kha), (uma), (cha) and (chha) re- spectively of the Service Rules. These four types of major penalties under Rule 40 (1) (Kha) can be inflicted upon a delinquent employee considering the gravity of the offence committed by him. Accordingly, Rule "40(1) (L) (A)" provides for demotion of an employee to a lower post or to a lower grade of service scale, Rule "40(1) (L) (Av)" pro- vides for realization of the financial loss caused to the Rural Electrification Board from the salary or other entitle- ments of the employee and Rule "40(1) (L) (B)" provides for removal (অপসারণ) from service but "40(1) (L) (C)" pro- vides for dismissal (বরখাস্ত) from service. In the REB Service Rules, 1990 there is no definition of removal (অপসারণ) and dismissal (বরখাস্ত). But according to the REB Service Rules, there is some dif- ference between dismissal and removal as to their consequences.
