The suit is apparently bad for defect of party; that the plaintiffs failed to prove the alleged story of transfer of the suit land by defendant No.25 to Masaddar Ali, plaintiffs' predecessor either by executing any document or by adduc- ing any evidence as payment of any consideration money, delivery of pos- session, and more particularly when P.W.1 in his deposition stated that ex- cept his oral statement there is no other material to show when and how the transfer took place, and in that view of the matter the claim of their acquisition of title relinquishment but that does not confer any title to the plaintiffs and the statement made in the said document is not sufficient to hold that the plaintiffs could establish their title to the suit land as the same is not a document of transfer.
