
Locus Standi
In the case of Surendranath Saha vs State reported in 12 DLR 178 it has been held that;
"Where a complaint of cheating before the court has been made not by the person defrauded but by another on his behalf the case must fail." [73 DLR (2021) 122]
Since the complaints in the present cases have not been filed by the person alleged to have been cheated it must be found that the complainant has no locus standi to make a complaint. [73 DLR (2021) 122]
