It is evident that the present respondent failed to fulfill the condition of his appointment i.e. he failed to pass the HSC examination within the prescribed time frame and also withdrawn MPO by filing false HSC certificate. His date of birth is also disputed one which can- not be resolved in the writ jurisdiction without taking evidence. ......(17)
