In the instant case the order of
dismissal has not been called in question in any court and it has not been
declared void, although the conviction of the respon- dent has been set aside
resulting in his acquittal. Therefore, the respondent is not entitled to
reinstatement on the ground of his acquittal in accordance with BADC
