Release
Release of an accused under the non repealed provision of section 167(7) Cr.P.C. is nothing but releasing the accused from custody for the time being without either discharging or acquitting him of the charges.
Such release did not create any vested right in favour of the accused. The accused is liable to face trial if released on bail or released under the provision of section 167 Cr.P.C. on re- vival of investigation. Kitab Ali Sikdar Vs. The State, 15BLD (HCD) 482
