Sec-52A, 54C- Revisional power- The findings of the last court of facts are based on evidence. The revisional court having a limited jurisdiction to see the error of law resulting in an error in the decision occasioning failure of justice has reversed the findings of facts there-by exercised its revisional power improperly.
The appeal is allowed. The judgment and order dated 06.07.1999 passed by the High Court Division in Civil Revision No. 185 of 1998 is hereby set aside......PDB, Khulna & others =VS= Southern Food Ltd, [1 LM (AD) 313]
