Admission of Appeal
No precondition can be attached to admission of appeal
Section 17 of the Family Courts Ordinance, 1985: As provided under Sub-section (1) and (6) of Section 17 of the Family Courts Ordinance, 1985. an appeal against judgment, decree or order passed by the Family Court shall lie to the District Judge. The right of appeal is statutory right. Therefore the admission of appeal cannot be subjected to any pre-condition as in the instant case. (Para13, Mr. Justice Md. Delwar Hossain). 15 MLR 51: Md.
