Whether the petitioners are entitled to reinstatement

The High Court Division held that since no inquiry of the Ansar department has found any involvement as regards most of the petitioners in the alleged 'mutiny' and since the competent Courts of this country have acquitted most of them in the criminal cases, the High Court Division is of the view that, those petitioners, against whom there was no established allegations in the proper enquiry done by the Ansar authority and against whom no allegations in criminal cases have been proved, are entitled to be reinstated in the Ansar battalions as reconstituted under the Act Nos. 3 and 4 of the 1995 as, in view of the provisions of Section 50 of the Act 3 of 1995, all the properties of the erstwhile Ansar would vest in the present Ansar Battalion and all the members of the previous Ansar would be regarded as the members of the present Ansar battalion as being enlisted or embodied. Therefore, since most of the petitioners have been able to prove their cases before the High Court Division in favour of their reinstatement in the erstwhile ansar, they are also entitled to be reinstated in the present Ansar battalions.
