Actual delivery of the boy is the essence of adoption

29 BLD 331 17 BLT 254: Sree Bemol Chandra Mohanto Vs. Sremoti Neoti Bala Dashsha & others: Physical act of giving and receiving is absolutely necessary to the validity of an adoption and it is the essence of adoption and the law does not accept any substitute for it. Mere expression of consent or the execution of a deed of adoption but not accompanied by an actual delivery of the boy does not operate as a valid adoption. (Para-11, Mr. Justice Md. Article 480(2)

According to Article 480(2) the adoptive father of the child to be adopted must belong to the same caste and that adoption would be valid if they belong to different sub-division of the same caste. [73 DLR (AD) 256]
