From the recitals of the deed in question it appears that being in need of money for marriage of the sister of the plaintiff respondent Nos. 1 to 3, the transaction was made and as such it does not come with the purview of Section 6 of the Act...... that the plaint also does not disclose any cause of action and as such.... the plaint ought to have been rejected and that having been not done there has been serious error of law committed by both the courts below.
