It
is an offence under the Penal Code and a person may be charged for abetting an
of- fence punishable under a special law al- though "abetment" may
not have been men- tioned as an offence under the Special Act- Penal Code.

Since
the condemned prisoner did not take any part in the act of killing his wife
Hazera, although he was a silent spectator to the murder of his by who acquitted
for want of legal evidence, he cannot be convicted under section 302 of the
Penal Code but he should be found guilty for abetment under sections 302/109 of

view of the fact that the FIR disclosed a prima case of abetment under section

Abetment
Suicide
in consequence of cruelties When a married woman is dragged to commit suicide
in consequence of cruelties perpetrated to her by the husband and other
relations, the consequent unfortunate death must be condemned and the abettor
or abet- tors need be punished for protecting the society against such
devillishacts.
Unfortunately
there is no provision in our laws to punish a person or persons whose cruel
behaviour dragged a married woman to commit suicide. Section 306 of the Penal
Code provides punishment to a person only in a case where suicide is abetted or
