Order VII, rules 11

In an application under Order VII, rule 11 of the Code the statement made in the plaint has to be looked into to determine if the suit does not disclose any cause of action under Order VII, rule 11 of the Code, it is the statement of the plaint which is the determining fact and it cannot be applied in the case of maintainability of the suit. ....(21) [73 DLR 97]
