1. This Rule is directed against an order passed by the Additional Sessions. Judge, Khulna, confirming the order passed by the learned Sub-Divisional Magistrate on 14-7-79 rejecting the Second party's prayer for dropping of the proceedings. We have heard the learned Counsels for the Second party-petitioner and the First Party-opposite party in the matter, perused the impugned orders and the records of the case. It appears that on the application of the First party a proceeding under section 145 of the Code of Criminal Procedure was drawn up on 24-10-78 and the land was attached and a Receiver was also appointed by the same order. It further appears that over the self tame land a Title suit No. 322 of 1969 was pending in the Court of Subordinate Judge, Khulna, wherein Injunction order dated 28-5-79 (Annexure "D" to the petition) was passed on the prayer of defendants Nos. 4 to 9, upon defendants 17 and 18 restraining them from entering into the suit land and from disturbing the peaceful possession of defendants 4 to 9. After the injunction order was passed the Second party moved the Sub Divisional Magistrate for dropping of the proceeding in view of the pendency of the Civil suit and the passing of the injunction order. It is pertinent to note in this connection that the injunction order was passed more than 8 months after the drawing up of the proceeding under section 145 of the Code of Criminal Procedure and when the Receiver had already gone into possession of the land under attachment in the proceeding the pendency of a Civil Suit is certainly no bar to the institution of proceeding under section 45 Cr. P.C. if the Magistrate is satisfied that there is immediate apprehension of breach of the peace. Having regard to those facts and circumstances we have no hesitation in holding that the learned Additional Sessions Judge had rightly affirmed the order of the learned Sub-Divisional Magistrate rejecting the prayer of the Second party for dropping of the proceeding on the ground stated in the impugned order.

2. In the result, the Rule is discharged. The order staying further proceeding in the matter is hereby vacated.

Let the case now be disposed of expeditiously.

The Receiver will, however, continue to function till the disposal of the proceeding under section 145 Cr. P.C. by the learned Magistrate.
